Houston Borough

Exclusive Use
The renter is granted exclusive use of the pavilion located in the Borough of Houston Public Park from noon until dusk on the selected rental date.

Fees and Deposit
A rental fee of $100.00 is required. This fee is non-refundable after the agreement is executed.
A separate refundable deposit of $25.00 is also required. The deposit will be returned provided all rules and conditions are followed. If paying by check, two separate checks are required (one for the rental fee and one for the deposit), payable to Houston Borough.

Maintenance
In return for the exclusive use of the Pavilion during the times as detailed above, the Renter shall be responsible for upkeep and maintenance of the Pavilion and the surrounding areas insuring that the Pavilion and surrounding areas. The following is a list of some of those responsibilities and includes but is not limited to the following:
1. Picking up all trash and debris from activities and / or events
2. Keeping the pavilion and surrounding area free of any and all trash, garbage, debris, papers, plastics and any waste generated by the Renters event or activity.
3. Protecting and preserving the equipment, benches, tables, facilities and other items in the Pavilion and surrounding areas from damage, defacement, destruction or any other misuse.
4. Maintaining appropriate noise levels throughout the Renters use of the Pavilion and surrounding areas in consideration of others use of the park and nearby residences and businesses.
5. Reporting immediately any damage, defacement, destruction or misuse of the Pavilion, its facilities or the surrounding facilities of the park.

The Renter shall be responsible for all enumerated items as well as any additional requirements requested by the Chairman of the Parks and Recreation Committee and/ the Borough.

Failure by the Renter to perform these or any other tasks may result in the retention by the Borough of the $25.00 deposit tendered with this agreement at the sole discretion of the Chairman of the Parks and Recreation Committee and/or Borough. Additionally, the Renter shall be responsible for any costs associated with their failure to perform the duties as detailed or requested under this Agreement or any costs associated with the repair and/or maintenance of equipment or facilities damaged by the Renter or the guests of the Renter.

Liability and Indemnification
The Renter shall indemnify, defend, and hold the Borough and its successors, heirs and assigns (including without limitation its and their officers, councilpersons, mayor, members, employees and agents) harmless from and against any and all loss or liability for or on account of any injury (including death) or damage received or sustained by and person or persons (including any employee, member, agent or invitee thereof) of any property by reason of any act of omission, whether negligent or otherwise, on the part of the Renter or any of the Renters invitees, guests, employees, agents, volunteers, or family in the course of the Renters activities pursuant to this Agreement and the activities of anyone entering the property pursuant to this Agreement and use of the Borough facilities.
Additional Terms
The renter agrees to comply with any additional requirements set by the Borough or the Parks and Recreation Committee.
